Crocs Sues Rival, Former Employee for Stealing Trade Secrets

In a 29-page complaint filed in federal court in Denver on July 6, Crocs alleges that defendants Joybees LLC and Kellen McCarvel, a former mid-level manager for Crocs, stole thousands of documents containing “highly confidential and proprietary” business information from the company. The lawsuit is the second filed by Crocs against McCarvel. The first federal complaint against him for breach of contract and theft of Crocs' trade secrets was filed in Oct. 2021.

In the most recent complaint, Crocs alleges McCarvel and others at Joybees hired former and current Crocs employees with different skillsets, knowledge, and documentation related to the design, development, and manufacturing of Crocs footwear. The group of former Crocs staffers hired included a quality engineer, director of manufacturing, and operations manager.

Joybees is the former USA Dawgs LLC, which utilizes contract manufacturers in Asia, China, and Mexico to make its Crocs-like footwear products.
